These Terms and Conditions govern the use of the Ratchada Niti website and, where applicable, the engagement of legal services provided by Ratchada Niti. By using this website or instructing us, you confirm your acceptance of these terms.

Use of this website constitutes acceptance of these terms. Individuals must be at least 18 years of age and have legal capacity to enter an agreement. If you are acting on behalf of a family or estate, you confirm that you have authority to do so.

3. Nature of Our Services

Ratchada Niti provides legal advice and representation in inheritance and estate matters governed by Thai law. Our services are not a substitute for general legal advice across other areas of law. Services are available to clients based in Thailand and to foreign nationals with matters connected to Thai assets or Thai law.

4. Engagement of Services

An engagement begins when both parties have agreed in writing to the scope, fee, and terms of the service. An initial consultation does not automatically create a continuing engagement. No legal relationship is formed by visiting this website or submitting an enquiry form.

Fees for each service are stated clearly before the engagement begins:

Fees are quoted in Thai Baht (฿). Payment is due as agreed in the engagement letter. We do not begin substantive work before agreed payment has been received. Additional disbursements (court filing fees, land office charges, etc.) are charged at cost and outlined in advance.

7. Refund Policy

For fixed-fee services (Consultation and Succession Guidance), a refund may be provided if the service has not yet commenced and written notice of cancellation is received at least 48 hours before the scheduled appointment. Once a service has commenced, fees are non-refundable unless we have failed to deliver the agreed service. For phased engagements, fees already paid for completed phases are non-refundable.

8. Intellectual Property

All content on this website, including text, design, and structure, is the property of Ratchada Niti. You may not reproduce, distribute, or modify any content without written permission. Legal documents prepared for you as part of a service engagement are your property upon full payment of the relevant fee.

9. Confidentiality

We maintain strict confidentiality over all information shared with us in the course of an engagement. This obligation continues after the conclusion of any matter. Our confidentiality obligations are described further in our engagement letters and are in addition to the professional obligations applicable to Thai legal practitioners.

Information on this website is provided for general guidance only and does not constitute legal advice for any specific situation. Legal outcomes depend on the particular facts of each matter and cannot be predicted with certainty. We do not make any representation about the outcome of any legal matter.

11. Limitation of Liability

To the extent permitted by Thai law, our liability arising from any engagement is limited to the fees paid for that engagement. We are not liable for indirect or consequential losses. This limitation does not apply to liability arising from fraud or wilful misconduct.

12. Termination

Either party may terminate an engagement by providing written notice. We reserve the right to terminate an engagement if a client provides false information, fails to cooperate, or acts in a manner that creates a professional conflict. Upon termination, we will provide a written summary of work completed to the date of notice and will retain any fees earned to that point.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from the use of this website or the provision of our services will be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand. We encourage parties to seek informal resolution before initiating any formal proceedings.
